COVID-19

“Sarah” is the mother of a six-year old boy and is also 4-months pregnant. Recently, Sarah fainted, but she was not alarmed because she had fainted and felt light-headed during her previous pregnancy. After telling her abusive ex-boyfriend, he demanded that she go to the hospital, refusing to return the couple’s child until she did so. She was concerned about potential exposure to COVID-19, but felt like she had no choice. After returning from the hospital, the father refused to return the child to Sarah, claiming she had been exposed to COVID-19 while at the hospital. Sarah had no symptoms and was not advised by the hospital to self-quarantine. She called the Counsel and Advocacy Law Line (CALL) for help. Lakeshore Legal Aid was able to file an emergency motion for return of the child and schedule a telephonic hearing. At the hearing, the Court ordered the father to return the child to Sarah and now both are safe and healthy at home.
