A client facing foreclosure came to legal aid for help. He had obtained the family home form his mother before her death. Soon after, he discovered that his mother had taken out a mortgage on the home, but that a release of the mortgage had been filed. The client thus continued to live in the home, paying property taxes and making repairs, for five years before the foreclosure was filed. Legal aid represented the client in the foreclosure case, and reached a settlement whereby the foreclosure was dismissed and a new release of mortgage was filed clarifying that the client owned the property free and clear of any liens. The client can continue to live in the family home, avoiding displacement and homelessness.
