A young mother contacted legal aid after her ex-husband, who had recently been released from prison for a domestic violence charge, took their son from school and left the state. The ex-husband was in violation of their custody agreement that dictated exchanges every 48 hours without leaving the state. Legal Aid successfully filed an emergency motion to modify the custody agreement and the child was returned to her care. Legal aid also achieved a temporary suspension of the father’s parenting time pending a full hearing. At the hearing, the mother was able to secure sole custody of her child.
